A local authority is fighting a legal battle to keep a 92-year old man suffering from dementia in a care home against his will.

A local authority is fighting a legal battle to keep a 92-year old man suffering from dementia in a care home against his will, on the grounds he lacks the mental capacity to determine his best interests.

According to reports in The Times, which has secured access to attend proceedings held in Court of Protection which normally sits in private, the elderly man's son, who has launched legal proceedings, said his father has clearly expressed the wish to stay at home.
