Councils in Scotland will soon have a duty to consider whether information shared with other organisations would protect children's rights and privacy. Under the incoming Children and Young People (Information Sharing) Bill, all public bodies will have to ensure any information shared is consistent with existing laws.
The new bill was created after the Supreme Court ruled that aspects of Scotland's Named Person scheme – under which an individual will be appointed to monitor the welfare of every child in the country – breached the right to privacy and a family life.
